Terms & Conditions

These terms also apply when you book, visit, or take part in any OCNJ Watersports activity: The Yard (Sky Net playground and Golf & Sports Simulator), the Beachy Tiki boat rides (Big Tiki and Little Tikis), Shark Bait Charters fishing trips, and the Aqua Park. In these terms, "OCNJ Watersports," "we," "us," and "our" mean OCNJ Watersports Corp. and the companies listed in Section 1.

1. Who Provides Your Activity

OCNJ Watersports Corp., 741 West Ave, Ocean City, NJ 08226, is the parent company. Each activity is run by its own company, and the company that runs an activity is the party that provides that activity to you:

• Beachy Tiki (Big Tiki and Little Tikis): Beachy Tiki LLC
• Aqua Park: Totally Tubular Aqua Park LLC, doing business as OCNJ Watersports Aqua Park
• Shark Bait Charters: Shark Bait Charters LLC
• The Yard: The Yard OCNJ LLC and The Yard Club LLC

Staff at all of our activities are employed by Can Do OC LLC, our staffing company.

3. Bookings and Payment

• How to book. You can book online through our FareHarbor booking pages, which are linked from our websites, or by phone. For The Yard, call 609-398-3345. For all other activities, call 609-398-9000.
• Payment. Payment terms are shown at checkout. Prices are in U.S. dollars, and any taxes and fees are shown before you pay.
• Confirmation. Your booking is confirmed once you receive a confirmation from FareHarbor. Please check your booking details (date, time, activity, and number of guests) and contact us right away if something is wrong.
• Prices and availability. Prices, schedules, and availability can change. The price shown at checkout is the price that applies. Some activities depend on the tide (for example, Aqua Park time slots), so available times can vary from day to day.
• Check-in. Please arrive at the check-in time listed on your booking. If you arrive late, you may get less time or may not be able to join the activity.
• Group size and capacity. Every activity has a maximum group size, which is shown on the booking page (for example, up to 32 guests on the Big Tiki and up to 6 on a Little Tiki or Shark Bait Charters trip). We cannot go over posted vessel or venue capacity.
• Passes, memberships, and class packs. Aqua Park Pass Packs, season passes, The Yard memberships, and class packs are covered by the terms shown when you buy them. Passes and memberships cannot be transferred, and booking ahead is recommended because walk-ups are not guaranteed. Pass holders may need to send a photo so we can verify them at check-in.

4. Cancellations, Refunds, and Rescheduling

Each activity has its own cancellation, refund, and rescheduling policy. That policy is shown at booking and in your booking confirmation, and it applies to your reservation. Please review it before you book. Questions? Call 609-398-9000, or 609-398-3345 for The Yard.

5. Weather, Tides, and Closures

• Rain or shine. Our activities generally operate rain or shine.
• When we cancel. Your safety comes first. We may cancel, shorten, delay, or change an activity because of weather, water or tide conditions, equipment problems, or other safety concerns. If we cancel, we will contact you, and the policy shown at booking and in your confirmation applies.
• Tide-dependent activities. Some activities, including the Aqua Park, depend on the tide. Time slots can change from day to day.
• Seasonal closures. Some activities are seasonal, and some may be closed for an entire season. When an activity is closed, we post a notice on that activity's website (for example, "Closed for the 2026 season. Reopening June 2027"). Current status:
  • Beachy Tiki boat rides (Big Tiki and Little Tikis, 228 Bay Ave, Ocean City Boathouse Marina): closed for the 2026 season.
  • Shark Bait Charters: closed. Reopens May 2027.
  • Aqua Park: closed. Reopens June 2027.
  • The Yard (741 West Ave): open. Check theyardocnj.com or call 609-398-3345 for hours.
• Booking during a closure. Our online booking links may stay active while an activity is closed so that you can reserve dates after it reopens. A live booking link does not mean the activity is open now. Please check the closure notice and the dates offered at checkout, and contact us if you have questions.
• Closure dates may change. Posted reopening dates are our current plan and may change. If we cannot run an activity on the date you booked, we will contact you.

6. Waivers and Assumption of Risk

• A signed waiver is required for every activity. Every participant must have a signed liability waiver before taking part in any OCNJ Watersports activity. A parent or legal guardian must sign for any participant under 18. We encourage you to complete waivers before you arrive.
• No waiver, no participation. A participant without a signed waiver cannot take part, and the cancellation policy shown at booking applies.
• Assumption of risk. Activities on the water, on boats and docks, on inflatable obstacles, and on elevated nets involve risks that cannot be fully removed. These include slips, falls, collisions, sun and heat exposure, water hazards, and injuries from physical activity. By taking part, you accept these risks for yourself. The signed waiver for an activity controls if it differs from this summary.
• Health and fitness. Participants should be in good physical condition. Pregnant guests are asked not to take part in watersport activities or Sky Net activities. Guests with known medical conditions (for example, heart conditions, recent surgery, or mobility limitations) should talk to a doctor before taking part, and staff may restrict participation if it seems unsafe.
• Safety rules and staff instructions. You agree to follow posted rules, safety briefings, and instructions from our captains, mates, lifeguards, and staff, including instructions about wearing life jackets. Aqua Park sessions are supervised by lifeguards, and life jackets are provided.

7. Age, Height, and Supervision Rules

• Supervision. Parents and guardians are responsible for supervising the children in their care at all of our activities.
• The Yard (Sky Net and Under the Net): Sky Net is for ages 2 and up. Under the Net is for ages 1 and up. Children under 3 must have a parent with them in the net. Closed-toe sneakers are required for Sky Net participants.
• Golf & Sports Simulator at The Yard: Ages 5 and up.
• Beachy Tiki (Big Tiki and Little Tikis) and Shark Bait Charters: All ages are welcome.
• Aqua Park (reopens June 2027): Ages 6 and up for regular sessions. Younger children may join designated "Small Splash" sessions. The ages for each session are shown at booking.
• Other requirements. Any other age, height, weight, or participation requirements for an activity are shown at booking and at check-in, and staff will apply them for everyone's safety.

8. Guest Conduct, Damage, and Right to Refuse Service

• Be safe and respectful. Please treat staff, crew, and other guests with respect and follow all safety instructions.
• No smoking or vaping. Smoking and vaping are not allowed at any time on the boats, docks, or property.
• Alcohol (BYOB). BYOB is allowed only where we say so:
  • Beachy Tiki cruises are BYOB (beer, wine, or seltzers). No glass bottles. Please bring a backpack or soft shoulder cooler only. Wheeled or hard coolers are not allowed.
  • At the Golf & Sports Simulator, BYOB is allowed only during private event-space rentals that start at 7:30 pm.
  • Only guests 21 or older (New Jersey's legal drinking age) may drink alcohol, and they must drink responsibly. Staff may ask for ID.
• Clothing and footwear. Wear clothing that suits the activity. On the Tiki boats, closed-toe shoes are recommended and high heels should not be worn. Sky Net participants need closed-toe sneakers.
• Damage. You are responsible for paying for damage you cause to our boats, equipment, or property beyond normal wear and tear. A parent or guardian is responsible for damage caused by a child in their care.
• Right to refuse service. We may refuse, limit, or end participation for any guest who appears impaired, ignores safety rules or staff instructions, acts in an unsafe, abusive, or disruptive way, or whose participation staff reasonably think is unsafe. Participation in Sky Net and other activities is subject to staff discretion. The policy shown at booking applies to any refund.

9. Gift Cards

• Where they can be used. OCNJ Watersports gift cards can be used for any OCNJ Watersports activity booked through our FareHarbor booking system. Gift cards can be printed from your confirmation email after purchase.
• No expiration and no fees. Our gift cards never expire and have no fees.
• No cash value. Gift cards have no cash value and cannot be exchanged for cash.
• Sales are final. Gift card purchases are final, non-refundable, and non-returnable.
• Lost or stolen cards. If your gift card is lost or stolen, we will replace it when you show proof of purchase (for example, your purchase confirmation email).

10. Photos and Media

• We take photos and video. OCNJ Watersports may take photos and video at its businesses and activities and use them on our websites and social media. By visiting or taking part in our activities, you acknowledge this.
• Buying your photos. Photos from your visit may be offered for sale through our online photo store (PicThrive), which is linked from our websites.

• Website content. Text, photos, logos, and other content on our websites belong to OCNJ Watersports or its licensors and may not be copied for commercial use without permission.

11. Limitation of Liability

• Who this covers. This section applies to OCNJ Watersports Corp., Beachy Tiki LLC, Totally Tubular Aqua Park LLC (doing business as OCNJ Watersports Aqua Park), Shark Bait Charters LLC, The Yard OCNJ LLC, The Yard Club LLC, Can Do OC LLC, and their owners, officers, employees, captains, and crew (together, the "OCNJ Parties").
• Liability cap. If any OCNJ Party is found liable to you for a claim arising out of a booking, a visit, or participation in an activity, the total amount all OCNJ Parties combined must pay you for that claim is limited to the amount you paid for the booking involved.
• What the cap does not cover. The liability cap does not apply to injury, loss, or damage caused by the gross negligence, recklessness, or intentional misconduct of an OCNJ Party. For those claims, the cap does not limit what you can recover.
• Personal belongings. The OCNJ Parties are not responsible for lost, stolen, or damaged personal belongings, including phones, cameras, and items dropped in the water. Please keep valuables secure or leave them at home.
• Your waiver. The waiver you sign for your activity is a separate agreement and continues to apply alongside this section.
• Website information. We try to keep information on our websites, such as prices, hours, and closure notices, accurate. If the website and your booking differ, the details shown at checkout and in your confirmation apply.

12. Third-Party Booking (FareHarbor)

• Online reservations, payments, gift cards, passes, and confirmations are handled by FareHarbor, a third-party booking platform. When you book, you also agree to the terms and policies presented at checkout, including the activity's cancellation, refund, and rescheduling policy, and FareHarbor's own terms and privacy policy apply to its handling of your information.
• Text-message opt-ins at booking are handled as described in the SMS Program Terms below.
• We are not responsible for outages or errors on third-party platforms, but we will help resolve booking problems. Call 609-398-9000, or 609-398-3345 for The Yard.
• Other third-party links on our websites (for example, our photo store, merchandise store, or partner businesses) are governed by those parties' own terms.

13. Governing Law and Disputes

These terms, and any dispute about them or about a booking, visit, or activity, are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules. Any lawsuit must be filed in the state courts located in Cape May County, New Jersey. There is no arbitration requirement.

14. Changes to These Terms

We may update these terms from time to time. When we do, we will post the updated version on this page and change the "Last updated" date. Changes apply from the date they are posted. The terms and cancellation policy shown at booking and in your confirmation apply to that booking.
